Terms and Conditions

Welcome to Altitude Global Logistic Pvt. Ltd. (AGL). These Terms and Conditions explain the terms under which our website and logistics services may be used. By accessing our website, requesting a quotation, or booking a service with us, you agree to the terms applicable to your use of the website or the service you have requested.

Please read these terms carefully. If you do not agree with the terms governing your use of the website, please discontinue using it. Individual shipments may also be subject to a separate quotation, service agreement, or carrier terms.

1. About Our Services

AGL provides logistics and freight-related services for domestic and international shipments. Depending on availability and the agreed scope of work, our services may include:

  • Air freight and ocean freight.
  • Full Container Load (FCL) and Less than Container Load (LCL) shipping.
  • Customs clearance and brokerage assistance.
  • Inland transportation.
  • Domestic and international courier services.
  • Warehousing and cargo handling.
  • Export-import consultancy and documentation assistance.

The availability, scope, and conditions of each service depend on the shipment requirements, route, cargo type, applicable regulations, and confirmation provided by AGL.

2. Quotations and Bookings

All quotations are based on the shipment information provided by the customer and the rates, schedules, and service availability at the time of preparation.

A quotation may be subject to a validity period, exclusions, additional charges, or other conditions stated in the quotation itself.

A booking is considered confirmed only after acceptance by AGL through an authorised communication and completion of any applicable booking requirements.

If the shipment details change or the quoted rates are no longer available before confirmation, the quotation may need to be revised. Any material changes to an existing confirmed booking will be handled according to the applicable agreement and law.

3. Customer Responsibilities

Customers are responsible for providing accurate, complete, and up-to-date information about their shipments.

This includes cargo description, quantity, weight, dimensions, declared value, pickup and delivery addresses, and all relevant consignor and consignee details.

Customers must also provide the required invoices, packing lists, permits, licences, declarations, and other documents within the applicable timelines.

Any special handling requirements, fragile goods, hazardous materials, restricted items, or other unusual cargo characteristics must be disclosed before booking.

AGL may request additional information or documents where necessary. A shipment may be delayed, placed on hold, or declined if the required information is missing, inaccurate, or inconsistent with applicable legal or operational requirements.

4. Pricing and Payments

Service charges will be communicated through the applicable quotation, invoice, or written agreement.

Unless expressly stated otherwise, quoted prices may exclude customs duties, taxes, government fees, storage, demurrage, detention, special handling, and other third-party or additional charges.

Additional charges may arise if the actual shipment details differ from those originally provided, the customer requests changes, or additional services become necessary.

Payment deadlines and payment methods will be stated in the applicable invoice or agreement. Customers are expected to pay amounts due within the agreed period.

Where payment is overdue, AGL may take reasonable and legally permitted steps to recover outstanding amounts or suspend further services, subject to the applicable agreement and any required notice.

5. Shipping and Delivery Timelines

AGL makes reasonable efforts to coordinate shipments and communicate relevant updates. However, transit times and delivery dates are estimates unless a specific commitment is expressly agreed to in writing.

Shipments may be affected by customs inspections, carrier schedules, weather, port congestion, regulatory requirements, strikes, public holidays, or other operational circumstances.

AGL will make reasonable efforts to address disruptions and communicate material updates when information is available. Any remedies relating to delays will be determined under the applicable agreement and law.

6. Customs Clearance and Compliance

Customs clearance is subject to the laws, procedures, inspections, assessments, and decisions of the relevant authorities.

Where customs clearance assistance is included in the agreed service, AGL will coordinate the process within the agreed scope of work. AGL cannot guarantee customs approval, release within a specific timeframe, or a particular duty assessment.

Customers must provide accurate declarations and all documents required for the shipment. Duties, taxes, penalties, inspections, and other government charges will be handled according to applicable law and the agreed allocation of responsibilities.

7. Restricted and Prohibited Goods

Customers must ensure that all goods presented for shipment may legally be transported, exported, imported, and delivered to the intended destination.

Dangerous, hazardous, prohibited, restricted, or specially regulated goods may be accepted only where legally permitted and expressly approved in advance.

AGL may refuse or suspend a shipment if the goods or documentation do not meet applicable legal, safety, or operational requirements. Any resulting costs will be handled according to the applicable agreement and law.

8. Packaging and Cargo Handling

Unless packaging is expressly included in the service, the customer is responsible for ensuring that goods are adequately packed, labelled, and secured for transportation.

Packaging should be appropriate for the nature of the cargo, its dimensions and weight, and the handling and transport conditions expected.

AGL may raise concerns or decline a shipment if its packaging creates a safety risk or is unsuitable for the agreed service.

9. Third-Party Service Providers

Depending on the shipment, AGL may coordinate services through airlines, shipping lines, courier operators, trucking companies, warehouses, ports, terminals, customs agents, and other service providers.

Such services may be subject to the relevant provider’s schedules, operating procedures, terms, and applicable liability rules.

AGL will coordinate services within the agreed scope of work. The responsibilities of AGL and third-party providers will depend on the applicable agreement and law. Nothing in these terms automatically removes AGL’s responsibility for its own contractual obligations or conduct.

10. Cargo Insurance

Cargo insurance is not included unless expressly stated in the quotation or confirmed in writing.

Customers should consider appropriate insurance based on the value and nature of their goods and the risks associated with transportation.

Where insurance is arranged, coverage, exclusions, deductibles, claim requirements, and settlement are governed by the applicable policy. AGL cannot guarantee that an insurer will approve a particular claim.

11. Loss, Damage, and Claims

Customers should inspect shipments upon delivery where practicable and notify AGL promptly if cargo appears lost, damaged, or incomplete.

Claims should include the shipment reference, relevant invoices, delivery records, photographs where available, and supporting documents.

Claims may be subject to specific notice periods and deadlines under the applicable contract, carrier terms, transport rules, or insurance policy. Customers should report issues promptly and preserve relevant evidence.

Liability and any available remedy will be assessed according to the agreed service, applicable contractual terms, and law. Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law.

12. Cancellations and Refunds

Cancellation and refund requests are governed by AGL’s Refund and Cancellation Policy and the terms agreed for the relevant shipment.

Refund eligibility may depend on the stage of the shipment, services already performed, and costs incurred with carriers or other providers.

Customers should submit cancellation requests as early as possible. A cancellation may not be possible after a shipment has been collected, dispatched, or handed over to a carrier.

Nothing in these terms removes any refund rights or remedies that cannot lawfully be excluded.

13. Website Use and Intellectual Property

The content on AGL’s website is provided for general informational purposes and may be updated from time to time.

Unless otherwise stated, website text, graphics, logos, design elements, and other original content are owned by or licensed to AGL. They must not be copied, republished, or commercially used without permission, except where permitted by law.

Users must not misuse the website, attempt unauthorised access, interfere with its operation, or submit unlawful or misleading information.

14. Privacy and Information Handling

AGL may collect and use contact details, business information, and shipment-related data to respond to enquiries, prepare quotations, coordinate services, communicate updates, process transactions, and meet legal obligations.

Personal information will be handled in accordance with AGL’s Privacy Policy and applicable data protection laws.

Customers should ensure they are authorised to provide any personal or third-party information submitted to AGL.

15. Suspension or Refusal of Services

AGL may refuse, suspend, or discontinue a service where reasonably necessary due to non-payment, inaccurate information, missing documents, legal restrictions, safety concerns, or a material breach of the applicable agreement.

Where practicable and legally permissible, AGL will inform the customer of the reason and any available next steps. Charges properly incurred before suspension or termination will be handled according to the applicable agreement and law.

16. Limitation of Liability

AGL’s liability for a shipment will be determined by the applicable service agreement, the nature of the services undertaken, relevant transport rules, and mandatory law.

Where legally permitted, liability may be subject to valid contractual limits or applicable statutory or international transport conventions.

AGL will not be responsible for losses that are lawfully excluded under the applicable agreement and law. However, nothing in these terms excludes or restricts liability for fraud, wilful misconduct, or any other liability that cannot legally be excluded or limited.

Customers who are shipping high-value or sensitive goods should request written clarification of applicable liability terms and consider suitable cargo insurance before confirming a booking.

17. Indemnity

To the extent permitted by law, customers may be responsible for reasonable losses, costs, claims, or expenses arising directly from their unlawful shipment, material misrepresentation, inaccurate documentation, or breach of the applicable agreement.

This does not apply to the extent that a loss results from AGL’s own breach of contract or other conduct for which AGL is legally responsible.

18. Complaints and Dispute Resolution

If you have a concern about an AGL service, please contact us with your shipment or invoice reference and a clear description of the issue.

We will make reasonable efforts to review the matter and resolve it through communication. This does not prevent either party from exercising any statutory rights or approaching a competent authority or court where legally entitled to do so.

19. Governing Law

These Terms and Conditions are governed by the laws of India.

Any dispute will be handled by a court or other forum having lawful jurisdiction over the matter, subject to applicable law and any valid written agreement between the parties.

20. Changes to These Terms

AGL may update these Terms and Conditions from time to time. The latest version will be published on the website with a revised effective or last-updated date.

Changes to an existing confirmed shipment or written service agreement will be governed by the terms applicable to that booking and the requirements of applicable law.
